Welcome to BookedKit. These Terms of Service ("Terms") govern your access to and use of the BookedKit website, application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
These Terms apply globally. Certain provisions may not apply to you depending on your location, and additional rights may be available to you under local laws.
1. Who We Are
BookedKit ("BookedKit," "we," "us," or "our") provides an online platform that allows users to create and publish customizable profile pages for professional and promotional use.
2. Eligibility
You must be at least 18 years old to use the Service. By using BookedKit, you represent and warrant that:

- You have the legal capacity to enter into these Terms
- You are not prohibited from using the Service under applicable law
3. Account Registration

We are not responsible for unauthorized access resulting from your failure to safeguard your credentials.
4. User Content
Ownership

License to BookedKit
By using the Service, you grant BookedKit a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.
This license ends when you remove your content or delete your account, except where content has been shared publicly and cannot reasonably be withdrawn.
Responsibility
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to your content
- Your content does not violate any law or third-party rights
- Your content is accurate and not misleading
- Your content complies with local advertising, copyright, and consumer protection laws applicable in your jurisdiction
BookedKit does not review or endorse User Content.
5. Prohibited Uses
You agree not to use the Service to:
- Violate any law or regulation
- Infringe intellectual property or privacy rights
- Upload malicious code, spam, or deceptive content
- Harass, abuse, or harm others
- Misrepresent yourself or your affiliations
We reserve the right to remove content or suspend accounts that violate these Terms.
6. Plans, Payments, and Billing
Some features require a paid subscription.

- Payments are processed by third-party providers (e.g., Stripe)
- Subscriptions renew automatically unless canceled
- You may upgrade, downgrade, or cancel at any time through your account
Fees are non-refundable except where required by applicable consumer protection laws, including laws in the European Union or Latin America.
7. Third-Party Services
The Service may integrate or link to third-party services (e.g., music platforms, analytics, payment processors). BookedKit is not responsible for third-party content, services, or policies.
Your use of third-party services is governed by their respective terms.
8. Availability and Changes
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
9. Termination
You may stop using the Service at any time.
We may suspend or terminate your access if:
- You violate these Terms
- Your use poses risk or harm to the Service or others
- Required by law
Upon termination, your right to use the Service ends immediately.
10. Disclaimer of Warranties
The service is provided "as is" and "as available."
BookedKit disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will meet your requirements or achieve specific outcomes, including bookings, opportunities, or professional success.
11. Limitation of Liability
To the maximum extent permitted by law, BookedKit shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunities.
Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to BookedKit in the twelve (12) months prior to the claim, or $100 if you have not paid any fees.
12. Indemnification
You agree to indemnify and hold harmless BookedKit and its affiliates from any claims, damages, liabilities, and expenses arising out of:
- Your use of the Service
- Your User Content
- Your violation of these Terms or applicable law
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
However, if you are a consumer residing in the European Union or a jurisdiction that provides mandatory consumer protections, nothing in this section deprives you of the protections afforded to you under the laws of your country of residence.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Service constitutes acceptance of the revised Terms.
16. Data Protection and Privacy (EU and International Users)
BookedKit processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 ("GDPR") and relevant laws in Latin America.

If you are located in the European Economic Area (EEA), you have the right to:

These Terms are written in English. If they are translated into another language, the English version shall prevail in the event of any conflict or inconsistency, except where prohibited by law.
